Terms of Service for The Prompt Power Code

1. Agreement to Terms

By accessing or using our website, thepromptpowercode.com (the "Site"), and the services, features, content, applications, or products offered by The Prompt Power Code ("we," "us," "our," or "The Prompt Power Code") (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our Services.

We may change these Terms from time to time. If we do, we will provide notice of such changes, such as by sending an email notification, providing notice through the Services, or updating the "Last Updated" date above. Your continued use of the Services after the revised Terms have been posted will constitute your acceptance of the changes.

2. Privacy Policy

Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. You acknowledge and agree that your use of the Services is subject to our Privacy Policy.

3. Eligibility and Account Registration

You must be at least 18 years of age to use our Services. If you are under 18 years of age (or the age of legal majority where you live), you may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account.

4. Purchases

General

If you wish to purchase any product or service made available through the Services ("Purchase"), you may be asked to supply certain information relevant to your Purchase. All payment processing is handled by third-party payment processors (e.g., Stripe). We are not responsible for any errors by the payment processor.

You represent and warrant that you have the legal right to use payment methods connected to any Purchase, and that information you provide is true, correct, and complete.

Subscriptions and billing

The core TPPC platform is sold on a recurring subscription basis unless a specific offer clearly states otherwise. Subscription interval, renewal behavior, invoice handling, and cancellation terms are shown at checkout and may also be managed through our billing portal when available. Legacy one-time purchases remain compatibility purchases and do not convert into subscriptions automatically.

Fixed-scope review services

When an offer is described as a one-time review, diagnostic, or pilot, the checkout page defines the included scope, delivery target, and fee. The AI Workflow Opportunity Review covers one submitted workflow. Automated analysis starts after confirmed payment and a sufficiently complete intake; most reviews are targeted for delivery within 10 minutes, while exception-gated reviews may take up to 24 hours. If one essential fact could materially change the recommendation, the service may ask one clarification question and resume automatically after the answer is submitted.

Refunds

The AI Workflow Opportunity Review may be refunded on request before automated analysis starts. Because analysis normally starts immediately after confirmed payment, that window may be brief. After analysis has started or a review has been delivered, fees are generally non-refundable except when required by law or when we cannot provide the purchased scope. Other digital products and services are generally non-refundable unless their checkout terms state otherwise.

5. Intellectual Property Rights

The Services and their original content (excluding user-provided content), features, and functionality remain the exclusive property of The Prompt Power Code and its licensors.

When you purchase our digital offerings (including workflow templates, reports, implementation assets, and downloadable materials), you are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works, publicly display, republish, or transmit these materials except for standard browser caching and temporary RAM storage required for usage.

6. User Conduct and Content

You are responsible for your conduct while using the Services and for any content you provide, including compliance with applicable laws and regulations. You agree not to use the Services for illegal activities, infringe intellectual property rights, submit abusive or unlawful content, or attempt unauthorized system access.

7. Termination

We may terminate or suspend your account and access to the Services without prior notice for breaches of these Terms or other legitimate reasons.

8. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

Workflow reviews, diagnostics, generated outputs, and implementation recommendations are decision support. They do not guarantee cost savings, revenue, regulatory compliance, or successful deployment. Your organization remains responsible for approvals, testing, security review, and production decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROMPT POWER CODE IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICES.

10. Governing Law

These Terms are governed by the laws of the United States.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance.
